The chapters in this volume address a variety of issues surrounding quotation, such as whether it is a pragmatic or semantic phenomenon, what varieties of quotation exist, and what speech acts are involved in quoting. Quotation poses problems for many prevailing theories of language. One fundamental principle is that for a language to be learnable, speakers must be able to derive the truth-conditions of sentences from the meanings of their parts. Another popular view is that indexical expressions like "I" display (...) a certain fixity -- that they always refer to the speaker using them. Both of these tenets appear to be violated by quotation. This volume is suitable for scholars in philosophy of language, semantics, and pragmatics, and for graduate students in philosophy and linguistics. We invoke a triple rationale to rebut Hooper and Spicer's argument against mandatory helmet laws. First, we use the laws of physics and empirical studies to show how bicycle helmets afford substantial protection to the user. We show that Hooper and Spicer erroneously downplay helmet utility and that, as a result, their attack on the utilitarian argument for mandatory helmet laws is weakened. Next, we refute their claim that helmet legislation comprises unjustified paternalism. We show the healthcare costs of bareheaded (...) riding to pose significant third party harms. It follows, we argue, that a utilitarian case for helmet laws can be sustained by appeal to Mill's Harm Principle. Finally, we reject Hooper and Spicer's claim that helmet laws unjustly penalise cyclists for their own health-affecting behaviour. Rather, we show their argument to suffer by disanalogy with medical cases where injustice may be more evident, for example, denial of bypass surgery to smokers. We conclude that mandatory helmet laws offer substantial utility and are entirely defensible within the framework of a liberal democracy. (shrink)

This chapter presents a synopsis of the historical evidence concerning the expansion of slavery and the trade in ivory during the Turco-Egyptian era in the Sudan between 1820 and 1881, and a description of the results of recent and very preliminary archaeological investigations at three sites associated with this trade around the town of Rumbek in Lakes State, South Sudan. The chapter begins with a brief review of the establishment of Ottoman rule in Egypt, before moving on to consider the (...) broader geopolitical forces that gave rise to the decision by the Egyptian Khedive, Mehmed Ali, to invade Sinnar, Kordofan and adjacent areas of northern Sudan. It then discusses the economic consequences and legal changes following the establishment of Turco-Egyptian rule that helped create the conditions for the expansion of slaving expeditions into southern Sudan and the establishment of a series of fortified camps or zaribas in these areas. Culture and Enlightenment are the two words that best characterise the essence of György Markus's career, in whose honour this book is published. Markus devoted the last twenty years of research towards a theory of cultural objectivations and their pragmatics, and the great depth of his knowledge of the history of culture and philosophy informs all his teaching and writing. The pursuit of Enlightenment ideals attains reflective self-consciousness in Markus' works; forged in the knowledge of its own historicity, of the (...) embeddedness of rationalities in culture and in an awareness of the paradoxes that cling to the conscious affirmation of ideals which are no longer self evident or beyond questioning. In taking up the challenge of these paradoxes, Markus spans the whole history of modern philosophy and culture with a matchless authority.This book draws together contributions from leading figures in contemporary philosophy, who are also friends, colleagues and former students of György Markus. Paul C. Johnson begins his new work, Automatic Religion, with the observation that two of the capacities commonly taken to distinguish humans from nonhumans-free will and religion-are fundamentally opposed. Free will enjoys a central place in our ideas of spontaneity, authorship, and the conscious weighing of alternatives. Meanwhile, religion is less a quest for agency than a series of practices--possession rituals being the most spectacular though by no means the only examples--that temporarily relieve individuals of their will. What, (...) then, is agency and why has it occupied such a central place in theories of the human? Based on a dozen years of archival and ethnographic research in Brazil and France, this book tests the boundaries between humans and non-humans in an unlikely series of episodes from the closing decades of the nineteenth century, when ideas related to automatism lurched into motion on multiple tracks and, not incidentally, "religion" as a topic of study was being born. Brazil provided a particularly fertile place for reflection as the nearest site of what Europeans and Euro-Americans too often, too naïvely, and too imperially saw as raw nature, and thus also a laboratory of the human. In this context, the French would call Brazil's people monkeys; its slaves were called automatons; and Afro-Brazilian spirit possession priests were classed in the terms of French psychiatry's newly minted terms, dissociation and hysteria. Johnson shows not just how automatons can take on unexpectedly human-like lives when animated but also traces how certain groups have been excluded as less-than-human. In so doing, Johnson reanimates one of the most mysterious and yet foundational questions of trans-Atlantic thought-what is agency? (shrink)

The Sexual Offences Act 2003 introduced a new statutory offence of "sexual activity in a public lavatory" into English law. Although written as a gender-neutral offence, the statute was formulated and enacted on the basis of concerns about male homosexual sexual activity in public lavatories ("cottaging"). This paper examines the justifications for, and implications of, the legislation. It considers the main arguments made in support of the offence and situates these within established moral, legal, and social debates about homosexuality. The (...) paper considers the relationship between conceptions of public and private morality in relation to the legal regulation of homosexual sex. It goes on to explore the complex nature of regulating public sex in relation to sexual practices which often maintain high degrees of privacy. Human experts are the source of knowledge required to develop computer systems that perform at an expert level. Human beings are not, however, able to reliably express what they know. As a result, experts often develop non-authentic accounts of their own expertise. These accounts, here termed reconstructed methods of reasoning, lead to computer systems that perform at a high level of proficiency but have the disadvantage that they often do not reflect the heuristics and processing constraints of a system user. (...) Reconstructed methods of reasoning are compared with authentic methods derived from the study of expert human behavior. Tests are proposed to establish the authenticity of reasoning methods and examples from medical diagnosis are used to illustrate how authentic methods of reasoning can be incorporated into an expert computer system. In a letter to his friend Drury, Wittgenstein claims to have been working on the same problems that Plato was working on in the Theaetetus. In this paper I try to say what that problem might have been. In the alternative reading of the dialogue that I construct here, attention is drawn to Socrates' frequent appeal in the course of discussion to the ordinary ways of speaking that he, and Theaetetus, and everyone else in Athens at the time engaged in. The more abstruse theories of Heraclitus and Protagoras which Socrates and Theaetetus are discussing are found to do violence to these ordinary ways of talking, and found seriously wanting as a result. A case is made that the conventions and presuppositions of ordinary conversational speech are inherently normative, and constitute a valid standard against which philosophical theories may be measured. Lines of affinity are drawn between these claims advanced by Plato and the recent work of contemporary neo-pragmatists, and Robert Brandom's work in particular. (shrink)

As a 2006 Institute of Medicine report highlights, surprisingly little empirical attention has been paid to how prisoners arrive at decisions to participate in modern research. With our study, we aimed to fill this gap by identifying a more comprehensive range of factors as reported by prisoners themselves during semistructured interviews. Our participants described a diverse range of motives, both favoring and opposing their eventual decision to join. Many are well-recognized considerations among nonincarcerated clinical research participants, including a desire for (...) various forms of personal benefit, altruism, and concern about study risks and inconveniences. However, a number of influences seem unique to prisoners. Participants did not report that they were not coerced into enrolling, and they have even been under pressure not to enroll. However, many sought to enroll in order to obtain access to better health care, raising a concern about whether they were unfairly exploited. (shrink)

The debate on the value of Boyer's minimally counter-intuitive theory continues to generate considerable theoretical and empirical attention. Although the theory offers an explanation as to why certain cultural texts and narratives are particularly well conveyed and transmitted, amidst society and over time, conflicting evidence remains for any mnemonic advantage of minimally counter-intuitive concepts. In an effort to reconcile these conflicting results, Barrett has made a comprehensive attempt in presenting a formal system for quantifying counter – intuitiveness including a distinction (...) between counter-intuitive and counter-schematic concepts. The present article uses this system to generate sentences containing different levels of counter-intuitiveness, and tests whether minimally counter-intuitive items show a mnemonic advantage over concepts which are more counter-intuitive or counter-schematic. Results indicate that MCI concepts hold a mnemonic advantage over counter-schematic and maximally counter-intuitive concepts but only for one-week delayed recall. Interference effects may have masked immediate recall effects. Yes-no recognition after one week delay showed almost 100% accuracy suggesting that availability of retrieval cues is the factor which determines the mnemonic advantage of MCI concepts. (shrink)

Defective newborn children are to be considered human persons. Thus, primary duty in proxy consent is to act with the infant's best interest in mind. This duty may at times override the otherwise prima facie right to life, but only under restricted circumstances. Refinements of McCormick's “relational potential” criteria and of ordinary-extraordinary means analysis prove useful in such decisions. Utilitarian considerations of social consequences have impact but can be kept subsidiary. The importance for decision making of available child support services (...) is considered. This article outlines a theory of naive probability. According to the theory, individuals who are unfamiliar with the probability calculus can infer the probabilities of events in an extensional way: They construct mental models of what is true in the various possibilities. Each model represents an equiprobable alternative unless individuals have beliefs to the contrary, in which case some models will have higher probabilities than others. The probability of an event depends on the proportion of models in which it occurs. (...) The theory predicts several phenomena of reasoning about absolute probabilities, including typical biases. It correctly predicts certain cognitive illusions in inferences about relative probabilities. It accommodates reasoning based on numerical premises, and it explains how naive reasoners can infer posterior probabilities without relying on Bayes's theorem. An investigation is presented in which a computer simulation model (DIAGNOSER) is used to develop and test predictions for behavior of subjects in a task of medical diagnosis. The first experiment employed a process‐tracing methodology in order to compare hypothesis generation and evaluation behavior of DIAGNOSER with individuals at different levels of expertise (students, trainees, experts). A second experiment performed with only DIAGNOSER identified conditions under which errors in reasoning in the first experiment could be related to interpretation of specific (...) data items. Predictions derived from DIAGNOSER's performance were tested in a third experiment with a new sample of subjects. Data from the three experiments indicated that (1) form of diagnostic reasoning was similar for all subjects trained in medicine and for the simulation model, (2) substance of diagnostic reasoning employed by the simulation model was parable with that of the more expert subjects, and (3) errors in subjects' reasoning were attributable to deficiencies in disease knowledge and the interpretation of specific patient data cues predicted by the simulation model. This article examines a recent judgment by the European Court of Human Rights that upheld the complaint of a homosexual woman who alleged that her application for authorization to adopt a child had been refused by domestic French authorities on the grounds of her sexual orientation. I argue that the judgment constitutes an innovative and atypical legal consideration of, and challenge to, the heteronormative social relations of contemporary European societies. After exploring the evidence presented by the applicant, and the Court’s (...) interpretation of it, I argue that in order to reach its judgment it was necessary for the Court to make a significant departure from its established jurisprudence in relation to sexual orientation. An essential element of this involved the adoption of a distinctive critical approach, strongly resonant with aspects of ‘queer theory’, which focused attention on the social, cultural and political construction of normative heterosexuality. Whilst a number of commentators have assessed the importance of the judgment in terms of its evolution of ‘gay rights’ in the area of family life, I argue that the Court’s reconceptualized ‘theoretical’ understanding of, and critical approach to, heteronormativity offers the potential to expand the scope of the European Convention on Human Rights across a number of areas of social life—in marriage, public assembly, freedom of expression, as well as family life—where non-heterosexuals continue to face discrimination in contemporary Europe.
